Albuquerque Truck Accident Lawyer for Serious Injury Claims

Injured in a crash with a semi-truck or commercial vehicle? Strong Law investigates the driver, carrier, cargo, maintenance, insurance, and electronic records that may affect your claim.

An Albuquerque truck accident lawyer helps people injured in crashes with semi-trucks, tractor-trailers, tankers, box trucks, dump trucks, delivery trucks, and other commercial vehicles identify responsible parties, preserve trucking records, and pursue compensation.

Truck accident claims are often more complicated than ordinary car accident cases. The investigation may involve a driver, motor carrier, cargo company, maintenance provider, vehicle owner, manufacturer, and several insurance policies. Federal trucking rules and company records may also affect how fault is divided.

Strong Law Accident & Injury Attorneys investigates both what happened on the road and what happened inside the trucking operation before the crash. We review driver conduct, company safety practices, electronic data, equipment condition, cargo records, insurance coverage, medical evidence, and the long-term effect of the injuries.

Do You Need a Lawyer After an Albuquerque Truck Accident?

Legal help may be important when a commercial truck crash causes hospitalization, surgery, a brain injury, spinal damage, fractures, burns, lost work, permanent disability, or the death of a family member.

An early case review may also matter when:

  • Several companies are connected to the truck or shipment
  • The truck or trailer may be repaired, moved, or returned to service
  • The trucking insurer contacts you quickly
  • The carrier is based outside New Mexico
  • The driver or carrier blames you for the collision
  • Electronic logs, video, vehicle data, or dispatch messages may be lost
  • A government truck, public agency, or road contractor may be involved

A commercial carrier may begin investigating within hours. Its insurer, safety department, lawyers, and reconstruction team may collect evidence before an injured person knows which records exist.

Strong Law offers free case reviews for people injured in commercial truck crashes throughout Albuquerque and Bernalillo County.

What Does an Albuquerque Truck Accident Lawyer Do?

A truck accident lawyer investigates the driver, trucking company, equipment, shipment, contracts, insurance, and electronic records connected to the collision.

Strong Law may help identify the motor carrier and other companies involved, preserve important records and physical evidence, review the crash report and video, investigate commercial insurance, document the injuries, negotiate with insurers, and file a lawsuit when needed.

The investigation should match the facts. A fatigue case may depend on driver logs, ELD data, fuel receipts, and dispatch records. A brake-failure case may turn on inspection and repair files. A cargo-shift case may require loading documents, weight records, photographs, and bills of lading.

¿Por qué las reclamaciones por accidentes de camiones son diferentes de las reclamaciones por accidentes de automóviles?

A commercial truck crash may involve several companies with different duties.

The truck driver may have controlled the vehicle, while the motor carrier controlled hiring, dispatch, training, scheduling, maintenance, or safety policies. A separate company may have owned the tractor or trailer. Another business may have loaded the cargo, arranged the shipment, repaired the brakes, or manufactured a failed component.

Truck cases also create records that do not usually exist in a passenger-car claim. Those records may show:

  • How long the driver had been working and where the truck traveled
  • Whether the driver was speeding or braking before impact
  • What the company told the driver to do
  • Whether inspections and repairs occurred
  • What the truck was carrying and who loaded or secured it
  • Which companies controlled the trip

Commercial insurance may also be more complicated. Coverage can include a motor carrier’s liability policy, excess coverage, policies held by owners or contractors, and insurance carried by other responsible companies.

Nuestros abogado de accidentes automovilísticos en Albuquerque page explains insurance and evidence issues that apply mainly to passenger-vehicle collisions.

Who May Be Responsible for an Albuquerque Truck Crash?

Responsibility depends on what each person or company did, what it controlled, and how its conduct contributed to the collision. A business is not automatically liable merely because its name appears on a truck or shipping document.

El conductor del camión

A driver may be responsible for speeding, distraction, unsafe lane changes, following too closely, impairment, fatigue, failure to inspect the truck, or driving too fast for traffic and weather conditions.

El transportista

The motor carrier is generally the company operating the commercial vehicle. It may be responsible for the driver’s conduct or for its own failures involving hiring, training, supervision, scheduling, dispatch, maintenance, recordkeeping, or safety policies.

The carrier may have a different name from the truck owner, broker, shipper, or company shown on the trailer.

A Freight Broker

A freight broker arranges transportation between a shipper and a carrier but generally does not operate the truck.

A broker may become part of a claim under limited facts, such as when its own conduct created a risk or it exercised meaningful control over the transportation. Federal law can affect broker-related claims, so responsibility must be reviewed case by case.

A Shipper or Cargo-Loading Company

A shipper, warehouse, loading contractor, or other business may be responsible when cargo was overloaded, poorly secured, unevenly distributed, or incorrectly documented.

Cargo problems can contribute to rollovers, jackknifes, lost loads, trailer sway, and difficulty stopping.

A Maintenance or Inspection Provider

A repair shop or maintenance contractor may be responsible when negligent service contributed to brake failure, tire failure, steering problems, lighting defects, or another unsafe condition.

Un fabricante

A product claim may exist when a defective tire, brake component, steering part, coupling system, underride guard, or other product helped cause the crash or made the injuries worse.

The truck, trailer, and failed component should be preserved before repair or testing changes their condition.

A Vehicle Owner or Leasing Company

The owner of a tractor or trailer may be involved depending on maintenance duties, contracts, control, and why the vehicle was supplied. Federal law may limit claims based only on ownership, so the facts must be examined carefully.

A Government Entity or Road Contractor

Some collisions involve public vehicles, maintenance crews, construction zones, traffic-control plans, or roadway conditions. Government immunity, special notice rules, and contractor responsibility may all require review.

What Should You Do After a Semi-Truck Crash in Albuquerque?

  1. Llame al 911 y solicite ayuda médica. Truck crashes can cause serious injuries even when symptoms are not immediately obvious.
  2. Reporta la colisión. Law enforcement records may identify the driver, carrier, witnesses, citations, and insurance information.
  3. Photograph the truck and trailer. Capture the carrier name, USDOT number, truck number, trailer number, license plates, logos, cargo, damage, road conditions, and the wider scene.
  4. Recopile información de los testigos. Do not assume every witness will appear in the crash report.
  5. Preserve damaged property. Avoid disposing of a vehicle, helmet, clothing, phone, or other physical evidence before it is documented.
  6. Save all records. Keep medical papers, bills, work notes, towing records, repair estimates, photographs, and insurer messages.
  7. Evite adivinar cuál es la culpa. Do not estimate speed, distance, visibility, or recovery when you do not know the answer.
  8. Solicite una revisión legal temprana. Electronic data, video, internal messages, and physical evidence may be overwritten, repaired, or discarded.

How Can You Identify the Trucking Company?

Photograph any company name, USDOT number, truck number, trailer number, license plate, and other markings visible on the tractor and trailer.

La Administración Federal de Seguridad de Autotransportistas Resumen de la empresa SAFER allows the public to search by USDOT number, MC/MX number, or company name. The snapshot may provide the carrier’s identity, size, commodity information, safety rating if one exists, roadside inspection information, and reported crash data.

This can help distinguish among:

  • The motor carrier operating the truck
  • The tractor or trailer owner
  • A freight broker or shipper
  • El empleador del conductor
  • A company whose logo appears on the trailer

A SAFER record does not prove that a carrier caused a particular collision. It is an identification and public-record tool that can guide a deeper investigation.

What Trucking Evidence Should Be Preserved?

Truck accident evidence can show how the driver operated the vehicle, what the carrier knew, and whether the equipment or shipment was safe.

La evidencia importante puede incluir:

  • ELD records and supporting documents: Driver logs, duty status, fuel receipts, toll records, delivery documents, and location data may reveal fatigue, schedule pressure, or inaccurate records.
  • ECM and telematics data: The truck’s electronic systems may contain speed, braking, throttle, engine, movement, and location information.
  • Video and photographs: Dashcams, driver-facing cameras, traffic cameras, business video, and residential footage may show signals, traffic flow, lane position, visibility, or the impact.
  • Dispatch and communications: Texts, calls, emails, app messages, and route instructions may show schedule changes, warnings, distraction, or company pressure.
  • Driver qualification and training files: These may include licensing, medical qualifications, driving history, background checks, training, and safety reviews.
  • Registros de inspección y mantenimiento: Repair files, inspection reports, tire records, brake work, driver complaints, and service history may reveal equipment problems.
  • Registros de carga: Bills of lading, loading diagrams, weight tickets, seal records, photographs, and contracts may identify the shipment and who loaded or secured it.
  • Testing and accident records: Post-crash testing and the carrier’s accident register may become relevant when federal requirements apply.
  • Contracts and insurance policies: These records may help identify control, legal duties, indemnity agreements, and available coverage.

Not every record exists in every case. The truck, route, cargo, carrier, and crash type determine which documents and federal rules apply.

How Long Do Trucking Companies Keep Important Records?

Federal rules establish minimum retention periods for certain records, but those periods are not a reason to delay an investigation.

Motor carriers generally must keep driver records of duty status and supporting documents for at least six months under 49 CFR § 395.8. A qualifying accident register is generally kept for three years. Required maintenance records are generally retained for one year while the carrier controls the vehicle and for six months after the vehicle leaves its control.

Other material, including dashcam footage, telematics, internal messages, and third-party surveillance video, may follow shorter company schedules or be overwritten automatically.

A preservation request may direct the carrier and other companies to retain specific documents, data, vehicles, parts, and communications. Regulatory retention does not guarantee that an injured person will automatically receive the information.

Which Federal Trucking Rules May Affect a Claim?

Federal Motor Carrier Safety Regulations may apply depending on the vehicle, cargo, route, and trucking operation.

Hours of Service and Electronic Logs

Hours-of-service rules limit how long covered commercial drivers may drive or remain on duty. Many drivers must use electronic logging devices to record duty status.

ELDs can record driving time and other vehicle information. The records may help determine whether fatigue, false logs, or schedule pressure contributed to the crash.

Cualificaciones del conductor

Motor carriers may have duties involving licensing, medical qualification, driving history, prior-employer safety information, and driver qualification files.

The investigation may examine whether the carrier properly reviewed the driver before allowing that person to operate a commercial vehicle.

Inspección, reparación y mantenimiento

Covered motor carriers must systematically inspect, repair, and maintain their vehicles.

Maintenance records may reveal repeated brake problems, worn tires, missed inspections, unresolved driver complaints, or repair work completed shortly before the collision. The federal maintenance requirements appear in 49 CFR § 396.3.

Carga y aseguramiento de carga

Federal rules may govern how certain cargo must be distributed, restrained, and secured.

The investigation may need to determine who loaded the trailer, who inspected it, whether the weight was within legal limits, and whether the cargo shifted or fell.

Pruebas posteriores al accidente

Federal rules require post-accident drug or alcohol testing only when defined conditions are met. Testing is not automatically required after every commercial vehicle collision. The applicable conditions are explained in 49 CFR § 382.303.

Registros de accidentes

Qualifying motor carriers must maintain an accident register containing basic information about reportable crashes for three years. The register may help identify the event and the carrier’s required reporting, but it does not prove fault by itself.

A federal safety violation does not automatically establish civil liability. The evidence must still connect the violation to the collision and resulting injuries.

Where Do Truck Accidents Happen in Albuquerque?

Albuquerque is crossed by I-25 and I-40, which meet at the Big I near the center of the city. The interchange carries local traffic along with regional and interstate commercial vehicles.

NMDOT describes the Big I as the connection between two of New Mexico’s busiest highways. Its Big I Operations Study focuses on congestion, ramp design, merging, and safety at the interchange.

Truck crashes may also occur along Rio Bravo Boulevard, Coors Boulevard, Paseo del Norte, Unser Boulevard, Broadway Boulevard, and routes serving industrial, warehouse, construction, and delivery areas.

An NMDOT study covering I-40 from the Arizona state line to the eastern edge of Albuquerque found increased heavy-truck involvement in crashes during its 2016–2021 review period. The study identified sideswipe, rear-end, and overturn collisions as recurring crash types within that reviewed corridor.

Those findings describe a specific studied section of I-40. They do not mean that every Albuquerque road, trucking company, or commercial driver is unsafe.

How Is Fault Determined After a New Mexico Truck Accident?

Fault depends on the conduct of every person and company that contributed to the crash.

The investigation may ask:

  • Did the driver operate the truck safely?
  • Did the carrier hire and supervise the driver properly?
  • Did scheduling or dispatch practices encourage unsafe driving?
  • ¿Se inspeccionó y mantuvo el camión adecuadamente?
  • Was the cargo loaded and secured safely?
  • Did a defective part, another driver, or a roadway condition contribute?

New Mexico follows pure comparative fault. An injured person may still recover when partly responsible, but compensation can be reduced by that person’s percentage of fault.

For example, if damages were $1 million and the injured person were assigned 20% of the fault, the potential recovery could be reduced to $800,000.

A trucking company or insurer may name several other parties in an effort to reduce its share. Its proposed fault allocation is not final.

What Insurance May Cover a Commercial Truck Crash?

A truck accident may involve several layers of insurance rather than one ordinary auto policy.

La cobertura posible puede incluir:

  • The motor carrier’s commercial liability policy
  • Excess or umbrella coverage
  • Insurance held by a tractor or trailer owner
  • Coverage for a contractor, employer, shipper, or loading company
  • A maintenance provider’s liability policy
  • Product-liability insurance
  • The injured person’s UM/UIM coverage in qualifying circumstances

Commercial policy limits vary based on the operation, cargo, contracts, federal requirements, and coverage purchased. Not every semi-truck carries the same amount of insurance.

Coverage disputes may involve whether the driver was authorized, whether the carrier operated under another company’s authority, whether an exclusion applies, or which policy must pay first.

A crash involving a motorcycle may also involve severe injuries and specialized insurance issues. Our abogado de accidentes de motocicleta en Albuquerque page explains those claims in greater detail.

What Injuries Can a Truck Crash Cause?

The size and force of a commercial truck can cause severe and permanent injuries.

Truck accident injuries may include traumatic brain injuries, spinal cord damage, fractures, crush injuries, amputations, burns, internal injuries, organ damage, nerve injuries, scarring, chronic pain, and psychological trauma.

A serious head injury may require the diagnosis, cognitive evidence, and rehabilitation discussed on our Abogado de lesiones cerebrales en Albuquerque Desbobinador hidráulico de alta resistencia:Para bobinas de mayor peso o necesidades de automatización más elevadas, visite ladesbobinador hidráulico de alta resistencia.

Spinal trauma, amputation, paralysis, or another injury requiring lifelong care may overlap with an Reclamación por lesiones catastróficas en Albuquerque.

If a truck crash causes a death, the family may need guidance about the personal representative, beneficiaries, estate issues, deadlines, and available losses. Those issues are addressed on our Abogado de muerte por negligencia en Albuquerque Desbobinador hidráulico de alta resistencia:Para bobinas de mayor peso o necesidades de automatización más elevadas, visite ladesbobinador hidráulico de alta resistencia.

¿Qué compensación puede estar disponible?

Compensation depends on fault, medical evidence, future needs, earning effects, available insurance, and the full impact of the injuries.

DAÑOS ECONÓMICOS

Economic damages cover measurable financial losses. They may include emergency care, hospitalization, surgery, rehabilitation, medication, future treatment, lost wages, reduced earning ability, vehicle damage, transportation, home modifications, mobility equipment, and long-term help.

DAÑOS NO ECONÓMICOS

Non-economic damages address personal effects that do not appear on a bill. They may include physical pain, emotional distress, scarring, disfigurement, permanent impairment, reduced independence, and loss of normal activities.

Daños Punitivos

Punitive damages may be considered in limited cases involving conduct more serious than ordinary negligence.

New Mexico law may permit punitive damages for conduct that is malicious, willful, reckless, wanton, fraudulent, or in bad faith. They are not automatic merely because a serious crash occurred or a regulation was violated.

There is no reliable average value for every Albuquerque truck accident claim. Two crashes involving similar vehicles may produce very different injuries, insurance disputes, income loss, and future-care needs.

How Long Do You Have to File a New Mexico Truck Accident Claim?

Many New Mexico lawsuits based on personal injury generally must be filed within three years under Estatuto de Nuevo México § 37-1-8.

Different rules may apply to claims involving a government truck, public employee, fatal collision, minor, defective product, insurance dispute, federal vehicle, out-of-state defendant, or another state’s law.

The correct deadline depends on the facts, parties, and legal claims. Do not wait for the filing deadline. Trucking evidence may disappear or become harder to obtain long before the time to file a lawsuit expires.

What if a Government Truck or Public Agency Was Involved?

A collision involving a City of Albuquerque vehicle, state truck, public employee, road crew, or government contractor may require special procedures.

A qualifying New Mexico Tort Claims Act matter may require written notice within 90 days, and a separate two-year lawsuit period may apply. The notice generally must identify the time, place, and circumstances of the injury. A qualifying wrongful death notice may have a six-month period.

Government immunity must also be waived for the type of claim involved. A contractor working on a public project may have separate responsibility and insurance. New Mexico provides an official Proceso de notificación de reclamación por daños y perjuicios.

A crash involving a federal truck or federal employee follows different federal procedures and should be reviewed immediately.

How Does an Albuquerque Truck Accident Claim Move Forward?

  1. Revisión gratuita de su caso. Strong Law reviews the crash, injuries, companies involved, insurance contact, and urgent evidence issues.
  2. Carrier and party identification. The driver, motor carrier, owner, broker, shipper, loader, maintenance provider, and other relevant businesses are identified.
  3. Preservación de evidencia. Written requests may seek ELD data, vehicle modules, dashcam footage, dispatch records, phones, inspections, maintenance files, cargo documents, and the truck and trailer.
  4. Fault and regulation review. Driver conduct, company practices, federal rules, equipment condition, cargo handling, and roadway evidence are examined.
  5. Insurance investigation. Commercial liability, excess, contractor, product, and other available policies are reviewed.
  6. Documentación médica y financiera. Treatment, work restrictions, income loss, disability, future care, and daily-life changes are developed.
  7. Demanda y negociaciones. The responsible parties and insurers receive a claim supported by the available evidence.
  8. Litigios cuando sea necesario. A lawsuit may be filed when fault, insurance, causation, or fair compensation remains disputed.

The process can change when a carrier is based outside New Mexico or when several companies bring claims against one another. Strong Law reviews jurisdiction and filing options based on the facts rather than assuming every truck case follows the same path.

Frequently Asked Questions About Albuquerque Truck Accidents

What does an Albuquerque truck accident lawyer do?

A truck accident lawyer identifies responsible companies, preserves trucking evidence, investigates federal and state safety issues, reviews commercial insurance, documents injuries, negotiates with insurers, and files a lawsuit when needed.

¿Quién puede ser responsable además del conductor del camión?

Possible parties include the motor carrier, vehicle owner, shipper, cargo loader, maintenance provider, manufacturer, and, under limited facts, a broker or public entity. Responsibility depends on control, contracts, conduct, and causation.

How do I identify the trucking company?

Photograph the company name, USDOT number, truck number, trailer number, plate, and logos. FMCSA’s SAFER Company Snapshot can be searched using a USDOT number, MC/MX number, or company name.

What evidence can disappear after a truck crash?

ELD information, dashcam footage, telematics, dispatch messages, phone records, third-party video, and damaged vehicle parts may be lost, overwritten, repaired, or discarded. Prompt preservation requests can be important.

Does an FMCSA violation automatically prove my case?

No. A federal safety violation may be important evidence, but it must still be connected to the collision and injuries. The defense may also dispute whether the rule applied or whether the violation caused the crash.

What if the trucking company is based outside New Mexico?

An out-of-state carrier can still be subject to a claim arising from a New Mexico collision. The correct court and applicable law depend on the crash location, parties, contracts, business contacts, and legal claims.

What if a government truck caused the crash?

A qualifying government claim may require written notice within 90 days and may have a separate two-year filing period. Government immunity and the correct notice recipient must also be reviewed.

¿Cuánto tiempo tengo para presentar una demanda por accidente de camión?

Many New Mexico injury claims generally have a three-year filing period. Government, wrongful death, product, federal, and other specialized claims may follow different rules.

What is my Albuquerque truck accident case worth?

Value depends on fault, injury severity, medical treatment, future care, income loss, permanent disability, available insurance, and the strength of the evidence. There is no reliable average value for every truck claim.

¿Cuánto tiempo tarda un reclamo por accidente de camión?

The timeline depends on medical recovery, the number of companies involved, the amount of evidence, insurance disputes, and whether litigation is required. Multi-party commercial cases often take longer than simpler claims.

¿Debo hablar con la aseguradora de la empresa de camiones?

You may need to provide basic notice, but be careful with a detailed or recorded statement. Avoid guessing about fault, speed, visibility, symptoms, or recovery.

How much does an Albuquerque truck accident lawyer cost?

Strong Law handles qualifying truck accident claims on a contingency fee basis. There are no upfront attorney fees or hourly bills, and attorney fees are not owed unless compensation is recovered.
